Das DJH hat in Folge Beschwerde beim Bundesgerichtshof eingelegt. Wie das Reisenetz nun berichtete, wurde diese Rechtsbeschwerde vom BGH zurückgewiesen. Das Urteil ist somit rechtskräftig, der Markeneintrag muss gelöscht werden.
Somit dürfen zukünftig auch Jugendunterkünfte, Hostels oder Gästehäuser, die nicht dem DJH angehören, den Begriff “Jugendherberge” für sich verwenden ohne der Gefahr der Abmahnung ausgesetzt zu sein. Der Rechtsstreit zwischen A&O und dem DJH dürfte nun ausgestanden sein. Eine weitere Instanz zur nochmaligen Revision oder Prüfung sieht das Rechtssystem nicht vor. Mit der nun endgültigen Löschung des Markenschutzes dürfte ein schwunghafter Handel mit Domainnamen beginnen, die den Begriff “Jugendherberge” enthalten.
